2. collection and storage of personal data and the nature and purpose of their use
a) Collection of data when visiting our website
When you visit the website www.tdwe.de, the browser used on your device automatically sends information to the website server. This information is temporarily stored in a so-called log file. The following information is collected without any action on your part and stored until it is automatically deleted:
- IP address of the requesting computer
- Date and time of access,
- Name and URL of the retrieved file,
- Website from which the access is made (referrer URL),

The aforementioned data is processed by tdwe for the following purposes:

- or other administrative purposes, such as ensuring the long-term functionality of our website.
The IP address is stored in encrypted form in the log files so that it cannot be traced back to your computer. The anonymous data of the server log files are stored separately from all personal data provided by a data subject. The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f GDPR. The legitimate interest in collecting the data follows from the purposes for data collection listed above and ultimately serves to ensure an optimal level of protection for the personal data processed by tdwe. Under no circumstances will the data collected be used for the purpose of drawing conclusions about your person.
In addition, cookies are used when you visit the website. You can find more detailed explanations on this in section 5 of this privacy policy.
b) Collection of data when contacting us electronically or by other means
If you contact tdwe electronically, by telephone or in person, the personal data you provide will be stored by tdwe for the purpose of processing and responding to your enquiry. It will not be passed on to third parties. The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. b GDPR. Your data will be deleted by tdwe after your enquiry has been answered, unless tdwe is entitled or obliged to store it for a longer period of time in accordance with Art. 6 para. 1 GDPR - for example due to a subsequent mandate. In these cases, you will be informed separately and personally about further data processing by tdwe employees.
c) Collection of data for applications and in the application process
Personal data of applicants are stored and processed by tdwe for the purpose of handling the application procedure. Processing may also be carried out electronically. This is particularly the case if an applicant sends the relevant application documents to tdwe electronically. The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. b GDPR.
If an employment contract is concluded with the applicant, the transmitted data will be stored for the purpose of processing the employment relationship in compliance with the statutory provisions. The applicant will be informed of this separately when the employment contract is concluded.
If no employment contract is concluded with the applicant, the application documents will be automatically deleted three months after notification of the rejection decision, unless deletion conflicts with any other legitimate interests of the controller. Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).
3. Routine deletion of personal data
Personal data of the respective data subjects are only processed or stored by tdwe for the period required to fulfil the purpose of storage or as required by law. The criteria for the duration of storage are, in particular, statutory retention periods.
If the storage purpose no longer applies or if a legally prescribed storage period expires, the personal data is routinely deleted in accordance with the statutory provisions.
4. forwarding of data
Your personal data will not be transferred to third parties for purposes other than those listed below. tdwe will only pass on your personal data to third parties if:
- you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,
- the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. f GDPR is necessary for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,
- there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and
- this is legally permissible and necessary for the processing of contractual relationships with you in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR.
5. cookies
tdwe uses cookies on the website. These are small files that your browser automatically creates and that are stored on your end device (laptop, tablet, smartphone, etc.) when you visit the website. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware. Information is stored in the cookie that results in each case in connection with the specific end device used. However, this does not mean that tdwe gains direct knowledge of your identity. This site uses the Google Maps map service via an API. The provider is Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.
To use the functions of Google Maps, it is necessary to save your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.
The use of Google Maps is in the interest of an appealing presentation of our online offers and to make it easy to find the places we have indicated on the website. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

tdwe does not use any tracking or analysis tools. Your data is also not used in the context of automated decision-making - in particular not for profiling purposes.
8. rights of data subjects
You have the right to
- in accordance with Art. 15 GDPR, to request information about your personal data processed by tdwe. In particular, you can request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of appeal, the origin of your data if it was not collected by us, as well as the existence of automated decision-making including profiling and, if applicable, meaningful information on its details;
- in accordance with Art. 16 GDPR, to immediately request the correction of incorrect or the completion of your personal data stored by tdwe;
- to demand the erasure of your personal data stored by tdwe in accordance with Art. 17 GDPR, unless the processing is necessary for exercising the right of freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;
- in accordance with Art. 18 GDPR, to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and tdwe no longer needs the data, but you need it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR;
- in accordance with Art. 20 GDPR, to receive your personal data that you have provided to tdwe in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller;
- in accordance with Art. 7 para. 3 GDPR, to revoke your consent to tdwe at any time. As a result, tdwe may no longer continue the data processing that was based on this consent in the future;
- to lodge a complaint with a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or the registered office of our law firm.
To exercise your rights as a data subject, simply send an email to email@tdwe.de or contact any employee of the law firm. The supervisory authority responsible for tdwe is the State Commissioner for Data Protection and Freedom of Information NRW, to whom you can address complaints.
9. right to object
If your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right to object, which will be implemented by us without specifying a particular situation.
